Welcome to Kids Dressy – NSU Design. By accessing or using our website (https://www.kidsdressy.com) and placing orders, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our services.

1. Definitions

“Company,” “we,” “us,” or “our” refers to Kids Dressy – NSU Design.
“Customer,” “you,” or “your” refers to any person who visits or makes a purchase through our Site.
“Order” means a purchase of Products submitted by you via our Site.
“Products” means any goods offered for sale on our Site.

2. Acceptance of Terms

By creating an account, placing an order, or otherwise using our Site, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy and Refund & Exchange Policy. These Terms constitute a binding contract between you and the Company.

3. Changes to Terms

We may revise these Terms at any time. Changes will take effect when posted on the Site. Your continued use of the Site after any such change constitutes your acceptance of the updated Terms. It is your responsibility to review the Terms periodically.

4. Account Registration

To place an Order, you may be required to register an account. You agree to provide accurate, current, and complete information during registration.
You are responsible for safeguarding your account credentials (username, password). Any activity that occurs through your account is your responsibility. Notify us immediately if you suspect unauthorized use.

5. Product Information & Availability

We strive to provide accurate product descriptions, images, dimensions, and colors. However, slight variations may occur due to screen settings or customization processes.
All Products are made-to-order. Once you confirm your Order, production begins immediately. Please review your customization details carefully.
We reserve the right to limit the quantity of any Product or to discontinue any Product without notice. If an item is out of stock or discontinued after you place an Order, we will notify you promptly and offer a substitute or refund.

6. Orders & Pricing

All prices are listed in the currency displayed on the Site and include applicable taxes, unless otherwise noted. Shipping fees are calculated at checkout and may vary by destination.
We reserve the right to update prices at any time; however, price changes will not apply to Orders already confirmed before the change.
Once you place an Order, you will receive an Order Confirmation email. This email does not signify our acceptance of your Order; it merely confirms that we have received it. Acceptance and formation of a binding contract occur when we send you a Shipping Confirmation email.

7. Payment

We accept payment via the methods displayed at checkout (e.g., credit cards, debit cards, PayPal). All payments are processed securely by our third-party payment processors; we do not store complete credit‐card information on our servers.
By submitting payment details, you represent and warrant that you are authorized to use the payment method you provide. If the payment cannot be processed, we reserve the right to cancel your Order.

8. Shipping & Delivery

Estimated processing times (production) and shipping times are provided on the Site. These are estimates and not guaranteed. Delays may occur due to factors outside our control (e.g., customs, weather).
Risk of loss or damage passes to you once the carrier picks up the shipment. It is your responsibility to track your Order and report any delivery issues promptly.

9. Refund & Exchange Policy

10. Intellectual Property

All content on the Site, including text, graphics, logos, images, designs, and software, is the property of Kids Dressy – NSU Design or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, transmit, or use any content from the Site for commercial purposes without our prior written consent.

11. User Conduct

When using our Site, you agree not to:

Violate any applicable laws or regulations.
Impersonate any person or entity.
Post or transmit harmful, obscene, defamatory, or infringing content.
Use robots, spiders, or automated means to access or scrape the Site.
Interfere with the operation of the Site or any user’s enjoyment of it.

12. Disclaimers & Limitation of Liability

Disclaimer of Warranties: The Site and all Products are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non‐infringement.
Limitation of Liability: To the maximum extent permitted by law, in no event shall Kids Dressy – NSU Design, its affiliates, officers, directors, employees, or agents be liable to you or any third party for any indirect, incidental, special, punitive, or consequential damages arising out of or related to these Terms, the Site, or the Products, even if advised of the possibility of such damages. Our total liability to you for any claim arising under these Terms shall not exceed the total amount you paid for the specific Product or service that gives rise to the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless Kids Dressy – NSU Design, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your use of the Site or Products,
Your breach of these Terms,
Your violation of any law or the rights of a third party, or
Any fraud, misrepresentation, or misconduct by you.

14. Governing Law & Dispute Resolution

These Terms and any disputes arising out of or relating to them or the Site shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict-of-law principles.
Any dispute, controversy, or claim arising under or relating to these Terms shall be exclusively submitted to the competent courts of Istanbul, Turkey. Both parties waive any objection to the exercise of jurisdiction and venue in such courts.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely matches the original intent.

16. Waiver

No failure or delay by us in exercising any right under these Terms shall operate as a waiver of such right. Any waiver must be in writing and signed by an authorized representative of Kids Dressy – NSU Design.

17. Entire Agreement

These Terms, together with our Privacy Policy and Refund & Exchange Policy, constitute the entire agreement between you and Kids Dressy – NSU Design regarding your use of the Site and supersede all prior or contemporaneous agreements, understandings, and communications.
